Recent CMS Rules Impacting Preschool and School Based Medicaid Claims

The New York State Education Department (SED) and the New York State Office of the Medicaid Inspector General (OMIG) want to provide you with as much information as possible regarding the Medicaid-in-Education programs in New York State.  The Centers for Medicare and Medicaid Services (CMS), the federal agency that oversees Medicaid programs nationwide, has been very active recently in issuing several rules impacting how each state implements their Medicaid-in-Education program. 

Final Rule CMS-2287 impacts New York State’s ability to claim Medicaid for special transportation services.  There is a moratorium in place that will push implementation of this rule to the beginning of the 2008 fall school year. Proposed Rule CMS-2237 will impact New York State’s ability to claim Medicaid for Targeted Case Management Services (IEP Reviews).  Impacted parties have until February 4, 2008 to submit comments to CMS. Sometime after that, CMS will implement the new rule. CMS may issue additional rules in the future.

Please know that New York State, along with members of Congress, other constituency groups and other states, have pursued moratoriums on the implementation of these rules and will continue to do so in an effort to maintain the Medicaid-in-Education program. There are also efforts in place to extend existing moratoriums.
