Alert #08-7

New York State Office of the Medicaid Inspector General (NYS OMIG)

School/Preschool Supportive Health Services Program (SSHSP/PSHSP)

Medicaid in Education Unit

Issue #8-7

TO:                      All SSHSP/PSHSP Medicaid Providers

FROM:                NYS OMIG SSHSP/PSHSP Medicaid in Education Unit

DATE:                October 9, 2008

SUBJECT:          Special Transportation Claims

The ability for School Districts and Counties to claim for Special Transportation Services that are documented with bus logs for attendance has been extended by Congress in the form of a Moratorium to CMS Rule 2287.  This moratorium is in place for Special Transportation services provided through March 31, 2009.

Note:  Special Transportation can only be claimed on a day when the child received a Medicaid covered service and only when round-trip attendance on the bus for that day is documented.

The affected rate codes are 5496 (SSHSP Special Transportation) for school districts, and 5327 (PSHSP Transportation) for counties.

Special Transportation will continue to be accepted by Central New York Regional Information Center (CNYRIC) with a date of service of March 31, 2009 or earlier.  CNYRIC will accept these claims and send them on to the State for processing.

CMS Rule 2287 scheduled to go into effect on April 1, 2009 will restrict Special Transportation claims to when transportation is provided to a site where only Medicaid billable services are provided without an educational component.

For any questions/comments regarding this alert, please contact your Regional Information Center representative, NYS Education Department Medicaid Coordinators, or NYS OMIG Medicaid in Education Unit staff.
