The Code of Federal Regulations [42CFR 440.110(c) 440.130(d)] has further clarified the issue of who may provide a referral for a Speech Evaluation and a recommendation for Speech Services in order to claim Medicaid reimbursement through the School Supportive Health Services Program and the Preschool Supportive Health Services Program.
In addition to the three alternatives listed in the May 1997 memorandum, you now have the following fourth alternative:
Effective July 1, 1997
Fourth Alternative:
Speech therapy services may be recommended in writing by a New York State Licensed Speech Pathologist in accordance with the frequency and duration as indicated on the student’s IEP.
Effective July 1, 1998
In addition to one of the four alternatives required or the 1997-98 school year, the following will also be accepted:
Speech evaluation may be referred in writing by a New York State Licensed Speech Pathologist.
If there is any change in what will be required for a Speech Evaluation effective July 1, 1998, you will be informed by the New York State Education Department in sufficient time to prepare for the 1998-99 school year.
Other Medicaid documentation requirements particularly the documentation required for the delivery of services has not changed.
A separate letter concerning Medicaid documentation requirements for authorizing speech evaluations and services under the Early Intervention Program will be sent under separate cover.
