Clarification regarding the Medicaid claiming of Speech Services provided students with disabilities in New York State

  

     Pursuant to Article 81 Section 3001 (2) of Education Law and Part 80-2.6 & 80-3.4 of the Regulations of the Commissioner speech services may only be provided to students with disabilities in New York State by a Certified Teacher of the Speech and Hearing Handicapped (TSHH).  In order to claim Medicaid for the speech services provided students with disabilities, the services must be provided by, or under the direction of, a New York State Licensed or ASHA Certified Speech Language Pathologist (SLP).

 

            The definition of "direction" is provided in the Medicaid Claiming/Billing Handbook - Update #5.  This handbook may be accessed through the New York State Medicaid Web Page at www.oms.nysed.gov/medicaid.  My May 23, 2003 memorandum provided the required and suggested methods of documenting "direction" for speech services provided by a Certified TSHH under the direction of an SLP.  This memorandum is posted on the New York State Medicaid Web Page.

 

     Direction must be provided when the only credential the service provider holds is a Certification as a TSHH.  If the service provider is a Certified TSHH as well as a New York State Licensed or ASHA Certified SLP, Direction does not have to be provided.  It is not necessary to provide direction to an individual who holds a credential as a Licensed or ASHA Certified SLP.  However, in either case, all the other required Medicaid documentation described in Handbook #5 and in recent memorandums posted on the Web from the New York State Education Department (SED) must be maintained in order to claim Medicaid.  The memorandum will also be posted on the New York State Medicaid Web page, address listed above.
