SED STATEMENT ON APPEAL OF COURT DECISION
REGARDING TEACHER EVALUATIONS

"Today, the Regents approved emergency regulations governing teacher evaluations that include provisions Albany County Supreme Court found invalid last month.  However, those provisions are only included in the emergency regulations to preserve SED’s right to appeal the court’s decision."

"While our appeal is pending, SED will not enforce the regulatory provisions that were overturned by the court."

"Pending the outcome of the appeal process, school districts and BOCES will be required to implement only those provisions of the evaluation regulations not impacted by the court decision.  SED will provide additional guidance to ensure the emergency regulations are implemented appropriately."
